Am I eligible for Financial Aid if I live with my boyfriend?

I am applying for school and I live with my boyfriend. I am not working and we have 2 children who he claims as dependents because he supports them. He also supports me, but we are not married. I am worried this will be an issue when applying for aid. Does anyone know how this works? Should I avoid anything when filling out the forms? Should I say that I live somewhere else??
I should add..I am 29 years old, and therefore Independent….my parents are not resp. for my education expenses. I am just a stay at home mom :) I file my taxes separately , but in 2008, he claimed me on his taxes as a dependent b/c he was supporting me and I was not working.

Excellent questions, but the answers may not be what you want to hear.

If your boyfriend provides greater than 50% of the financial support for his children, then HE is an independent student for financial aid purposes.

However, if you are not married to your boyfriend, YOU are not deemed responsible for his kids’ financial support, and the fact that you are living with him and/or them will have no impact on your financial aid dependency classification.

Therefore, you will have to look to the other criteria of the dependency classification to determine how you will be considered.

Unless you can answer “yes” to at least one of the following questions, you will be considered a dependent student for financial aid purposes:

You were born before January 1, 1985.

You are married, as of today.

You provide more than 50% of the financial support for non-child dependents who live in YOUR home.

You are an orphan, or you were declared a ward of the court before your 18th birthday.

You are a member, or have been a member of the US military.

You are a graduate student.

You have been declared legally emancipated by an appropriate US court of law, and you can provide the judge’s court order.

If you answered “yes” to any of those questions, you will be considered an “independent” student for federal financial aid purposes.

The question of your dependency classification relates to a determination of identifying the “household” that you can be considered to live in – therefore determining who is responsible for your college expenses. A lot of confusion comes from this – because it’s not where you’re actually living that matters – it doesn’t really matter if you live with a boyfriend, an aunt, a grandparent, a stranger, or on your own. If you do not meet one of the above criteria (age, marital status, military service, etc.), you are considered to be part of your parents’ household, and THEY are considered responsible for assisting you with your college expenses.

Again – this is another source of confusion – it’s not a question of whether your parents are WILLING to pay for your college education – the government still considers them RESPONSIBLE for helping you pay for your college education. Many parents are not willing – for any number of reasons, but the point is that the government will evaluate your financial aid eligibility based on your parents’ ABILITY to contribute – and not based on their willingness to contribute.

You’ll need to look over those criteria, and see what category you fall within. I would recommend that you not be tempted to fudge on any of these questions, because 30% of all FAFSA forms are randomly selected for “verification” each year.

Your best bet is to complete the FAFSA accurately, and see what forms of financial assistance you qualify for. The fact that you would have to provide your parents’ financial information on the form does not in any way mean that you will not qualify for considerable assistance.

Edit (in response to your additional information): If you are an independent student, and you do not file a joint tax return, your financial aid application will be based solely upon your financial circumstances. You will not be required to provide any information about your boyfriend’s income.

However – let me tell you this – if you report zero income for the 2008 tax year, the chances are exceptionally high that your FAFSA application will be selected for automatic verification. Support that you receive from your boyfriend is technically “untaxed income”, which should be entered on Worksheet B of the FAFSA package. Information entered on Worksheet B will be transferred to the appropriate question on the FAFSA itself.

I would strongly recommend that you seek the advice of an accountant or financial advisor as to how to properly claim a reasonable amount of your boyfriend’s financial support as untaxed income for FAFSA purposes.
